Consumer rights in Ireland

Consumer Protection Act 2007 · Sale of Goods and Supply of Services Act 1980 · European Communities (Consumer Information, Cancellation and Other Rights) Regulations 2013 (SI 484/2013) · E-Commerce Regulations 2003 (SI 68/2003)

· I ·Applicability

GuestlinePortal is a business-to-business service — subscribers are hotels or hotel groups acting in the course of business. Nonetheless, where a subscriber is legally a consumer under the Consumer Protection Act 2007 and the Sale of Goods and Supply of Services Act 1980, this notice sets out the consumer rights that apply. GuestlinePortal also grants equivalent discretionary rights to all Customers regardless of consumer status, as set out in /terms and /refund.

· II ·Right to information (SI 484/2013 Regulation 6)

Before you subscribe, we provide clear information on the identity of the trader (GuestlinePortal Ltd), the geographical address (21 Grafton Street, Dublin D02 XH54, Ireland), the phone (+353 1 447 55 20), the email (support@guestlineportal.com), the total price including VAT, the payment arrangements, the duration of the contract, the minimum duration of the consumer's obligations, and the arrangements for cancellation. This information is provided on the pricing page, the product pages and the checkout page and is repeated in the activation email you receive from mail.guestlineportal.com.

· III ·Right to cancel (SI 484/2013 Regulation 15)

Consumers who purchase online have a 14-day right of withdrawal without giving any reason. The 14-day period runs from the day the contract is concluded (the activation email). To exercise the right of withdrawal notify the trader by any unequivocal statement — for example an email to support@guestlineportal.com, a letter to the registered office, or by completing the standard cancellation form annexed to Schedule 3 of SI 484/2013. Refunds are made within 14 days of receipt of the withdrawal notice, using the same means of payment as the original transaction.

· IV ·Digital content and exercise of right of withdrawal

GuestlinePortal is a digital content service. Under Regulation 15(5) SI 484/2013 the right of withdrawal is lost if performance has begun with the consumer's prior express consent and acknowledgement that the right to withdraw will be lost. When you complete checkout you may choose to (a) wait 14 days before your subscription is activated, preserving the right of withdrawal, or (b) request immediate activation and expressly waive the right of withdrawal. · V ·Statutory rights on quality (Sale of Goods and Supply of Services Act 1980)

The service supplied is expected to be provided with due skill, care and diligence, using materials that are sound and reasonably fit for the purpose for which they are required. If the service is not so provided, statutory remedies include repair, replacement of the affected component, price reduction or termination with refund. These remedies are additional to any contractual remedies in the Terms.

· VI ·Unfair commercial practices (Consumer Protection Act 2007)

The Consumer Protection Act 2007 prohibits unfair, misleading and aggressive commercial practices. GuestlinePortal marketing communications adhere to this Act — prices, features and cancellation terms are stated clearly and are not obscured behind conditions in small print. Any complaint of unfair commercial practice may be made to the Competition and Consumer Protection Commission (CCPC) at Bloom House, Railway Street, Dublin 1, D01 C576, telephone 01 402 5555, web www.ccpc.ie.

· VII ·Complaints handling

Complaints should be addressed first to the Dublin desk at support@guestlineportal.com. We aim to acknowledge within one Irish working day and resolve within 15 working days. If you are not satisfied with the outcome you may (a) refer the matter to the CCPC, (b) use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or (c) commence proceedings in the Irish courts under the jurisdictional rules of the Consumer Protection Act 2007.

· VIII ·E-Commerce Regulations 2003 (SI 68/2003)

As an information society service established in Ireland, GuestlinePortal complies with the E-Commerce Regulations 2003 (SI 68/2003) transposing Directive 2000/31/EC. Contract formation is instantaneous on the acknowledgement email; the acknowledgement is sent by the mail relay from mail.guestlineportal.com and constitutes receipt for the purposes of Regulation 14. The contract is concluded in English and is retrievable from the Client Portal.

· IX ·Governing law and jurisdiction

Contracts with consumers resident in Ireland are governed by Irish law with the exclusive jurisdiction of the Irish courts, subject to any mandatory consumer protection provisions of another EU Member State where the consumer is habitually resident.
